BADIL

 يعتبر الأطفال الفلسطينيون اللاجئون الذين يشبو نفي آتون الصراع الاسرائيلي الفلسطيني المتواصل منذ زمن طويل,عرضة للخطر بشكل خاص وبحاجة الى حماية.لقد وجهت اطارف محلية ودولية فاعلة اهتماما كبيرا الى وضع الاطفال الفلسطينين تحت الاحتلال الاسرائيلي,ومراقبة حقوقهم وحمايتها بموجب القانون الدولي الانساني,وحقوق الانسان وبشكل خاص معاهدة جنيف الرابعة,والاتفاقية الدولية لحقوق الطفل, الا ان اهتماما اقل من  ذلك بكثير,حظيت به الحقيقة القائلة بأن نصف الاطفال الفلسطينين ,بانهم ايصا لاجئون , ولذا فأنهم جديرين بالحماية الخاصة التي يمنحهم اياها قانون اللاجئين الدولي.

ورقه بديل 10 هذه تنطر في حقوق الاطفال الفلسطينين اللاجئين , على هدي ثلاث مجموعات من  القانون الدولي ,وهي القانون الانسان, قانون حقوق الانسان, وقانون اللاجئين, والى جانبها ايضا قرارات الامم الامتحدة ذات الصلة. يتناول الجزء الاول من الورقة  البادئ العامة التي تحكم حماية ومساعدة الاطفال اللاجئين ,زيتبع ذلك تقدير للمبادئ التي حددتها   اتفاقية حقوق الطفل. ويراجع الجزء الثالث المبادء التي تحكم تطبيق الحلول الدائمة.ويستعرض الجزء الرابع المساعدات التي تقدمها وكالة الامم المتحدة لاغاثة وتشغيل اللاجئين الفلسطينين الأنوروا.ثم تختم الورقة ببعض التوصيات السياسية لتحسين المحاية. والبحث عن حلول دائمة للاطفال الفلسطينين اللاجئين.

Mohammad Khaled al-Aza’r is an independent Palestinian researcher based in Cairo. He is the author of a number of books and articles, including, Jerusalem, between the Intifada and Negotiations, Guaranteeing Palestinian Refugee Rights in the Current Political Settlement, and, The All Palestine Government at its 50th Anniversary.
